Terms and Conditions of advertising with Wales Tourists Online

Wales Tourists Online is herewith referred to as the publisher in these terms and conditions. The advertiser refers to the person who owns or operates the property, or their agent.


The publisher operates advertising services through the distribution of information on the internet. The advertising service provided consists of:Publication of information which has been provided by the advertiser On Wales Tourists Online siteIt is assumed that the advertiser understands the general principles of the internet including use of a web browser and e-mail programme.


All invoices will be sent via email unless requested by letter.Payment is due within 7 days unless otherwise stated.


The publisher will endeavour to maintain and increase the number of visitors to the website and create measurable response to advertisers in the form of enquiries delivered via their email in advertisements, by telephone if a telephone number is published in an advertisement, and, where a web link is published in an advertisement, by referrals to that website.The publisher will develop ongoing the website and associated systems to meet the changing requirements of web users, advertisers and technology. The emphasis of this development will be on delivery of detailed information to a sustained and relevant audience.


It is the policy of the publisher to communicate by e-mail wherever possible. Advertisers agree to receive relevant notices about the advertising or their account by e-mail as and when appropriate, and where response is required, to reply within seven days of receiving the e-mail.In cases where the advertiser prefers to be contacted by a method other than e-mail, a specific request, either by telephone or in writing must be sent.Correspondence is not entered into on operational issues.


The publisher accepts advertisements in good faith and requires advertisers to provide an accurate description of their property. Advertisements should comply with UK legislation including the Trade Descriptions Act 1968 (covering false descriptions) and the Consumer Protection Act 1987 (covering misleading prices).


The Publisher reserves the right to determine the design of its distribution channels, and the layout of the pages and individual advertisements.The publisher may at its discretion alter any of the pictures and/or text content which form the published content of advertisements.Website links will be published at the discretion of the publisher. These can redirect to a website solely marketing the accommodation, and cannot be used to redirect to another directory website. An additional charge can be made for the inclusion of a web link.The publisher will take care of photographs and other media provided for the preparation of advertisements, but cannot take liability for any loss or damage to them whilst in transit or in our possession. If return postage and packing has been sent, media will be returned as soon as it has been processed.The publisher will take care to accurately reproduce the information and pictures provided by advertisers, but will not be held liable for any loss arising out of any error or omission made while adding or amending these.PaymentInvoices will be sent by email. Unless previously agreedThe advertiser agrees to pay the publisher no later than seven days from invoice.


The publisher maintains editorial control over all the content distributed in its website


It is the responsibility of the advertiser to ensure they have the right to use any photograph, digital images or advertising copy which they supply us with. The advertiser agrees to indemnify the publisher against all claims costs arising out of any copyright infringement for such images or text.All images produced by the publisher from original files or photographs supplied by advertisers are the property of the advertiser. All descriptive text used in advertisements is the property of the advertiser. These pictures and text can only be published elsewhere with written permission from the advertiser.Advertisers who use e-mail as the primary channel for incoming enquiries do so completely at their own risk. Wales Tourists Online will take no responsibility for missed enquiries and possible resulting loss in such cases.


Advertisers undertake to check at publication, and from then at least every six months, that the content of their advertisement is correct and complete. Liability for any errors or omissions in the advertisement is the advertiser's responsibility and the publisher cannot be held in any way accountable for any consequences caused by such errors or omissions.The advertiser is solely responsible for dealing with persons who access their data and warrant that they will not refer complaints or enquiries about these to the publisher.In cases where the publisher receives a complaint about an advertiser's accommodation or conduct, the advertiser agrees to receive and give due attention to the matter, and to discuss and resolve it directly with the complainant. The publisher will not become involved in resolution of such matters in any way other than by sending an acknowledgement to the sender and forwarding the complaint to the advertiser.The advertising offered in the website may be used for lawful purposes only. The advertiser agrees to indemnify and hold the publisher harmless from any claims resulting from use of the publisher's website which causes damages to the advertiser or another party.Any liability to the advertiser in connection with this Contract will not exceed the price paid by the advertiser for the service. The publisher will have no liability for loss of profits, business, revenue, goodwill or anticipated savings or for any other indirect or consequential loss.


The publisher reserves the right to decline to publish any newly placed advertisement. If any payment has been made, this will be refunded or returned. No compensation will be payable by the publisher for any loss howsoever incurred if publication of an advertisement is declined.The publisher reserves the right to withdraw any published advertisement. In such cases, any payment which has been made will be refunded pro-rata based upon the number of days remaining until the previously scheduled expiry date. No other compensation will be payable by the publisher for any loss howsoever incurred if advertisement is withdrawn from publication.Annual advertising is a one-off charge and is non-refundable. An advertisement can be removed on the written request of the advertiser, but repayment will not be made for the 'unused' part of its run. It may be added into the site again on your request provided it is within the run of the original advertisement booking.The publisher reserves the right to suspend or terminate all or part of the service provided to a client with immediate effect, where [1] the expiry date has passed, or [2] there has been a breach by the client of these terms and conditions or failure to pay outstanding charges.


The publisher will make every effort to provide advertisers with a prompt service.Publication of newly placed advertisements: Subject to suitable text and image content being provided by advertisers, newly placed advertisements added on a paid basis will usually be published within 7 working days.Wales Tourists Online endeavours to maintain continuous availability of the website, but will not be liable if they are not accessible at any time or for any period. Notice will not necessarily be given if the website goes offline or services are temporarily withdrawn.


These terms and conditions take precedence over any other terms and conditions. The publisher reserves the right to amend these terms and conditions at any time without notice. Continued use of the service signifies agreement with any changes made to these terms and conditions.
